- Upon the death of the sole owner or owners with tenants in common, interest passes to the transfer on death beneficiary names in this deed.
- The T.O. D. interest does not encumber the property and the owner can transfer or mortgage the property without the consent of the beneficiary.
- The interest can be terminated by executing a new deed at any time and the property must be considered in the decedent's estate for Ohio and federal estate purposes.
- T.O.D. deeds will not be accepted by the county recorders at time of title transfer, only when one transfers from themselves to themselves, and the beneficiary must be specific individuals names, not their title or relationship.
